Tariffs
The U.S. Supreme Court agreed to hear an emergency appeal on President Trump’s use of the International Emergency Economic Powers Act (IEEPA) to impose tariffs on foreign countries. The Administration’s tariff actions were first challenged in federal district court, successfully asserting that tariff authority generally rests with Congress and not the executive branch. The Supreme Court will hear arguments on IEEPA authority the first week of November, with an expedited ruling soon to follow.
DTC Ads
The U.S. Dept. of Health and Human Services (HHS) announced an executive action aimed at pharmaceutical direct-to-consumer (DTC) advertising. Amidst ongoing complaints with ad content, primarily carried over television and radio, HHS will strengthen compliance with advertising requirements. OOH operates under a modified set of advertising rules and is not the subject of the agency’s stepped-up enforcement and scrutiny.
DOT Leaders
The Senate cleared a package of 48 nominations for positions throughout the Trump Administration. Among them were Sean McMaster, the new Administrator of the Federal Highway Administration, and Jonathan Morrison, the new Administrator of the National Highway Traffic Safety Administration. Both had been caught in a logjam of executive nominations pending before the full Senate since mid-summer.
U.S. House
The House Transportation & Infrastructure Committee, the main committee of policy jurisdiction for our industry, added a new member, Rep. Max Frost (FL). Longtime member Rep. Steve Cohen (TN), a senior leader on the Aviation Subcommittee, left for a spot on the House Intelligence Committee. Frost fills the vacancy created by his departure.
Federal – TSA
The Transportation Security Administration unveiled a “Families on the Fly” program, featuring airport processing lanes for families with children 12 and under. The program is available at 11 airports, including: Charleston (SC), Charlotte, Honolulu, Jacksonville, Oklahoma City, Orlando, Orange County (CA), Providence, Salt Lake City, San Juan, and Tampa.
