Michigan Supreme Court Reaffirms that Banning Billboards Is Illegal

The Supreme Court of Michigan has issued a decision in Adams Outdoor vs. The City of Holland which makes it clear that localities do not have the authority to prohibit billboards and that an ordinance that places a moratorium on the construction of new billboards violates that principle if the result is the eventual elimination of outdoor advertising.  In its decision, the Michigan Supreme Court held that while Holland's moratorium was not invalid on its face, the ordinance could be legitimately attacked where it can be established that such an ordinance is in operation.
